About Aluochier Dispute Resolution


Aluochier Dispute Resolution is an arbitral institution that administers arbitrations and mediations in accordance with Aluochier Dispute Resolution Arbitration Rules and Aluochier Dispute Resolution Mediation Rules, much like other reputable arbitral institutions in Kenya, Africa and the rest of the world. It was founded by Isaac Aluochier, FCIArb, CPM – an experienced arbitrator and mediator, whose professional background spans the construction, financial services and dispute resolution industries, in diverse roles including as quantity surveyor, project manager, contracts manager, claims consultant, litigator, party representative, arbitrator and mediator, with geographical experiences predominantly in England and Kenya.


In Kenya, the sovereign people have delegated their judicial authority not only to courts of law, but also to independent tribunals established by or under the Constitution of Kenya, 2010. Among the non-court dispute resolution mechanisms recognised in Kenya are negotiation, mediation, conciliation, arbitration and traditional dispute resolution, provided none of these mechanisms are in conflict with the Constitution and other written law. As the courts cater only to a small segment of the population, on account of various access to court justice issues, the alternative dispute resolution mechanisms recognised bridge the access to justice gap, enabling dispute resolution services to reach a wider segment of society, and not just in Kenya, but elsewhere in the world, and based on Kenyan dispute resolution procedural law.


Aluochier Dispute Resolution, in operating as an arbitral institution, contributes to the wider access to justice among those seeking to have their disputes resolved in accordance with law, and in a fair manner. As is the case with courts, where adversarial dispute resolution proceedings are instituted at Aluochier Dispute Resolution, without the concurrence of the person or persons sued, such proceedings, for accountability purposes, must be held in public and without compromising on fair administration of justice. But where disputing parties seek to resolve their dispute away from public eyes, they can agree to do so privately and in confidence, either in mediation or in arbitration.


Ultimately, the purpose of Aluochier Dispute Resolution is to deliver justice expeditiously, efficiently, lawfully, reasonably and in a procedurally fair manner, thereby enabling the peaceful resolution of disputes in a manner acceptable to those in dispute.
